Probate & Estate Planning

The attorneys practicing in our Probate & Estate Planning group are well-prepared to provide consultation and legal services involving a wide variety of vehicles for the transfer of wealth, reduction of tax, and preparation for unexpected medical or family events and emergencies.

Whether you need a simple will, a general power of attorney, or wish to explore a more complex plan to transfer wealth over a number of years, we have the experience and expertise to assist you. Our goal is to identify and coordinate an approach to an estate plan which meets the particular needs of our individual clients while minimizing taxes. Our lawyers are experienced in drafting wills, revocable trusts, irrevocable trusts, life insurance trusts, trusts for the benefit of children and grandchildren, and other documents needed for an estate plan. We frequently deal with families interested in the options for transferring or disposing of family owned businesses, creation of family partnerships, limited liability corporations, and other closely held business planning. We are experienced with all areas of estate taxation, gift taxation, employee benefits and retirement benefits, income taxation, and business planning. In addition, we frequently counsel clients concerning charitable giving, charitable trusts, foundations, and other planned giving strategies.

We also undertake and assist with the full administration of a decedent’s estate, or the release of a decedent’s estate from administration. This would include representation in the probate courts, the preparation of all necessary documents for filing with the probate courts, and consultations with heirs, devisees, legatees, and the preparation of all tax returns including individual income, fiduciary income, and federal and Ohio estate tax returns. We also work closely with the surviving spouse or family members to review any existing plan and changes that might be appropriate in light of the death of someone who was a part of a larger plan.
